DOWNING OF UKRAINIAN AIRLINES FLIGHT PS752
IRAN FAILS TO DEFEND AND IS NOTED IN DEFAULT IN ONTARIO LAWSUIT
TORONTO, December 23, 2020
On December 22, 2020, the Ontario Superior Court of Justice at Toronto noted the Islamic Republic of Iran, its Supreme Leader and other top Iranian officials in default in this lawsuit for failing to defend within the limitation period.
Under Ontario Court Rules, Iran is now deemed to admit the truth of all allegations of fact made in the Statement of Claim.
The Iranian defendants are no longer entitled to participate in the lawsuit without leave of the court.
In a procedural step that will move the case forward quickly, the court has directed the case transferred out of class action procedure and into the normal court track.
A Motion for Default Judgment will be scheduled to be heard by the Court in the early Spring
The lawsuit, filed in Toronto claims Iran committed an act of terrorism under the Canadian Justice for Victims of Terrorism Act when it shot down Ukraine Airlines Flight PS752 on January 8, 2020. All on board were killed including many Canadians.
