Canadian Court Awards $107 Million

The Ontario Superior Court of Justice awards $107,000,000.00 to the families of six victims in the shooting down of Ukraine Airlines Flight PS752 by the Islamic Republic of Iran.

January 3, 2022: In a Decision released today, the Ontario Superior Court of Justice awarded a total of $107 million plus interest and costs to the families of six victims who lost family members in the shooting down of Ukraine International Airlines flight PS752 by the Islamic Republic of Iran.

Today’s decision follows from the prior, May 20, 2021, Decision of the Court in which it found that the shooting down of the airplane was an intentional terrorist act perpetrated by Iran and the other defendants named in the Claim.

On January 8, 2020, the Islamic Republic of Iran fired two missiles into Ukraine International Airlines Flight 752 departing Tehran en route to Kyiv causing the aircraft to crash. Approximately 75 Canadians were killed.

The plaintiffs are some surviving family members who lost spouses, children, nieces and nephews. They filed a private law Claim in the Ontario Superior Court of Justice against the Islamic Republic of Iran and others responsible for the disaster. 

In 2012, the Justice for Victims of Terrorism Act and the State Immunity Act was amended to permit such claims to be brought against foreign states designated as state sponsors of terrorism. Canada designated the Islamic Republic of Iran as such a state.

This damages Decision of the Ontario Superior Court of Justice is unprecedented in Canadian law. It is significant for the impact it will have on immediate surviving family members seeking justice.
